Recent results for Lewis Nedas Law expert criminal defence lawyers

  1. gavelExcellent historic sexual allegation result for Lewis Nedas client and Tony Meisels; Tony represented an individual facing a long history of allegations of historic sexual assaults and rapes by family members, which were said to occur when all parties were either children or in their teens. Tony instructed the excellent Dee Connolly of Counsel. The client entered guilty pleas to two counts concerning one individual but denied the remaining allegations.

    As a result of detailed and difficult preparation for trial and Ms Connolly's superb advocacy, our client was acquitted of the numerous remaining allegations. He was sentenced by a highly experienced trial Judge and received a suspended sentence of imprisonment and a community sentence. The CPS then decided to Attorney General (AG) Reference the case, on the basis that they felt the the sentence was too low and inappropriate. Tony and Ms Connolly drafted a clear and comprehensive letter of objection to such a course, explaining the full circumstances and what had happened in court. This was enough to persuade the CPS to drop their proposed AG Reference.

    We have been successfully defending sexual allegations for many years, including the often more complex, difficult and sensitive historic sexual abuse allegations. We do so discreetly and in a low key manner, at reasonable rates and using the very best advocates and experts.

  2. Siobhain Egan successfully represented a political lobbyist investigated for dishonesty allegations; After making strong representations to the investigating authority, all matters were dropped;

Another successful outcome for firearms specialist Laura Saunsbury; In February 2017 an ordeal lasting nearly a year finally came to an end for a firearm and shotgun certificate holder who was accused of threatening his neighbour with a machete. Our client was acquitted following a two day trial at Lewes Crown Court. The case was expertly prepared by our firearms and weapons law specialist Laura. At the trial our client was skilfully represented by barrister Zeena Begum of 4 Kings Bench Walk, as demonstrated by the fact it took the jury only 18 minutes to reach a unanimous not guilty verdict. In expressing his appreciation our client had this to say about the way we handled his case: “I truly believe without Laura and Zeena I would have lost my case. So happy and relieved they got justice for me”.

Paul Mason interviewed by French television channel

press conferencePaul Mason, a Senior Consulant Solicitor here at Lewis Nedas, has been interviewed by a French television channel who are investigating the prosecution of child pornography and grooming offences in England and Wales. Of particular interest to the French investigative journalists was the role of self styled vigilantes in these types of offences.

Paul had recently successfully defended a client facing such allegations which were discontinued by the CPS because of the role played by such vigilantes, entrapment and the tainting of evidence.

More acquittals and successful results for Lewis Nedas Law criminal and fraud lawyers

  1. fraudUnan Choudhury represented an individual who was initially facing a large scale conspiracy to defraud prosecution. Unan successfully represented to the CPS that there was not a case for his client to answer and insufficient evidence to allow the case to go to the jury. The CPS agreed with Unan's assessment, a week before trial! They then substituted a charge of money laundering, as a small amount of the alleged proceeds of crime passed through his account. Our client agreed to plead guilty to this and was sentenced to 40 hours 'work in the community order' - his numerous co-defendants were convicted and sentenced to lengthy periods of imprisonment for the overarching allegation of fraud.

  2. Siobhain Egan represented a professional man accused of assaulting his children's tutor in his own home, and in front of his children. Our client, a man of good character, staunchly denied the offence, and we set about investigating and preparing his case. It was rapidly apparent that there was simply no information about the alleged victim, his apparent doctorate or qualifications anywhere! We also learned that he admitted use of class A drugs and that there had been allegations of his aggressive behaviour in the past. Rather unusually, we made an application to admit this evidence as 'bad character' against the alleged victim.The CPS were very uncooperative about this application and our persistent requests for disclosure in the case, reluctantly serving important information on the day of trial which required further investigation. Our client was represented by the excellent and tenacious barrister Rishi Nathwani, and was acquitted to his absolute delight and relief. The court made a defence costs in his favour.

  3. Siobhain also represented a City analyst investigated for fraud, as a result of strong representations made to the investigating authority, the prosecution was dropped. Had he been prosecuted he would have lost his Job and specialist professional status.

Another Acquittal for Lewis Nedas client facing Sexual Offence Prosecution

sex offencesUnan Choudhury represented a client of good character, who faced 4 allegations of sexual penetrative activity made by a very vulnerable Complainant who suffers from a mental disorder.

The CPS alleged that the Complainant’s mental disorder precluded her from being able to give consent to sexual activity.

The Crowns case relied upon the report of their expert, a psychiatrist, who concluded that because the Complainant’s IQ was below that of an average 13 year old, she would not have any understanding of consent or contraception.

Unan instructed a leading Consultant Psychologist to prepare an independent report on behalf of his client, noting that the CPS expert had not taken into account the Complainant’s interview with police, known as an ABE (assisting best evidence). During that interview with police, it was apparent that the Complainant did understand the concept of consent and knew what contraception was. She recognised what a condom was, and stated that one was used when she was with our client. This contrasted with the interview completed by the Crowns psychiatrist in the presence of the Complainant’s mother. Our expert concluded that the Crowns expert had not seen nor taken into account the ABE interview, and that it was very likely that the Complainant was embarrassed and hindered by the presence of her mother during the interview with the Crowns expert. Our defence expert concluded that this was a fundamental weakness within the Crowns report.

These issues were brought to the attention of the Trial Judge, who was sufficiently concerned and ordered that the Crowns expert reassess his report in light of our expert’s conclusions. This was done, and the CPS expert concluded after his reassessment that he could not conclude any longer that the Complainant could not consent because of her mental disorder.

As a result the CPS decided not to proceed with the prosecution, ending a lengthy and stressful ordeal for our client.
