Our firearms law specialist Laura Saunsbury has achieved another successful outcome for a keen shooter who was a Games Maker in the London 2012 Paralympic Games. Following a minor domestic argument in January 2012, Essex Police seized our client’s shotgun and certificate. He was not charged or cautioned for any criminal offence, and there had been no other domestic incidents before or since. In spite of that the Police retained the certificate and shotgun for more than 12 months.
It was only after Laura Saunsbury was asked to intervene and wrote to Essex Police that our client was served with formal revocation of his shotgun certificate and so able to pursue an appeal. Earlier this month the appeal was finally heard at Chelmsford Crown Court and our client was represented by specialist firearms barrister Nick Doherty. Under his expert cross-examination Assistant Chief Constable Wortley, who had authorised the revocation of our client’s certificate, acknowledged the delays which had taken place in this case were unacceptable, although since Lewis Nedas had become involved in the case and senior officers had taken over the decision making process, the matter had progressed in a timely fashion. In dismissing the Police objections, the Court accepted there was no evidence to support the assertion that our client’s possession of shotguns would present a danger to public safety or the peace. Essex Police were directed to reinstate his shotgun certificate for a full five year period so that he would not be required to undergo the renewal process at any time in the near future.
Laura’s careful and thorough preparation of the case was key to the successful outcome achieved.
