The idea of making a Will can be a difficult one and, as a result, many people put it off. However, a Will is vitally important to confirm what you want to happen to your assets after your death.

If you die without a Will, your assets will be distributed according to a set of standard legal rules. This can result in further upset for your family and an outcome you would not have wanted. Alternatively, if you have a valid Will in place, you can make sure your loved ones are protected and your wishes are honoured.

Here we discuss when is the right time to make a Will, or to update your existing Will. If you would like to discuss writing your Will with our experienced Wills Solicitors, contact us today.

When should you write a Will?

Generally, all adults should have a valid Will in place that clearly states their wishes and decisions. It is very easy to put off getting a Will until another time, or when you are older or in ill-health, but this is not the best course of action. One of the legal requirements of a valid Will is that you are of sound mind when you are creating it. Therefore, the best time to make one is when you are young, fit and healthy so there is no dispute that you understood the implications.

If you do not already have a Will and certain important life events occur, this is a good time to consider writing one. This will ensure you and your loved ones are protected without them being burdened with extra problems in resolving inheritance issues. These major life events can be broadly divided into two areas: a change to your financial circumstances or a change in your personal life.

A change to your financial circumstances

If your financial circumstances change in any considerable way, you should think about creating a Will to ensure your assets are protected for the future. If you already have a Will, you should update it to reflect any changes.

Considerable changes to your financial situation include (but are not limited to):

  • Inheriting money or property
  • Buying or selling a property
  • Getting a promotion or pay rise
  • Starting your own business

If your financial situation has recently changed and you need Wills advice and services, do not hesitate to get in touch with our team who will be delighted to help.

A change in your personal life

Changes in your personal life should also prompt you to write a Will or update your existing one. These changes include (among others):

  • Marriage (it is important to note that if you get married, any existing Will is immediately made void. It is very important to make sure that your current Will was drawn up after the marriage date.)
  • Divorce or separation
  • A new baby in the family
  • The death of an executor named in your Will
