Gary Conway recently represented a client who was the subject of a Crimewatch feature in 2012. He was later charged with a series of very grave offences, to which he had always and consistently asserted his innocence.

The sole allegation against him was that DNA was found on the inside cardboard of a roll of duct tape which was used to bind an elderly victim.

The client’s defence was that he had never been at the crime scene and that DNA must have been transferred on another occasion, or there was a mistake in the way DNA testing had been conducted.

The CPS then asserted that, given the location of the DNA evidence, he must have been the last person to touch the duct tape and therefore must have been at the scene.

This assertion was not supported by any of the evidence.

Gary instructed one of the country’s leading independent forensic experts, who raised serious questions as to the admissability of the Crown’s evidence and their conclusions. Upon receipt of our expert’s report, the CPS withdrew their prosecution.
