Mavalynne represented an individual who had a trial listed at Oxford Crown Court in November 2027 following charges of Possession of Imitation Firearm, Assault by Beating, Stalking, and Sending a communication threatening death or serious harm.
These allegations, which were made by his ex-partner, originally also included charges of controlling and coercive behaviour. However, due to the weaknesses of the evidence regarding these allegations which were highlighted at the early stages of the proceedings, the prosecution withdrew these charges before the matter was set for trial.
From the moment of arrest, the client was adamant that he was not guilty of these offences, and that stated that these allegations were completely made up and of a malicious nature. The defendant raised a complete defence and gave full detailed instructions to his defence team, highlighting crucial inconsistencies within the complainant’s evidence.
On the 1st of April the Prosecution confirmed they would be offering no evidence in respect of these allegations. Mavalynne’s client was understandably delighted with the result and very grateful for the joint efforts by his defence team in securing this result without having to wait for his trial date in 2027. The advocate was the excellent Kelly Purcell-Chandler from Cornwall Street Chambers.
Successfully defending crown courts trials of this nature can be very difficult, and it is unusual for the Prosecution to offer no evidence serious allegations within a domestic context so far ahead of trial. Achieving such a result for any client takes great expertise and dedication.
