Pre-Nuptial Agreements (before marriage) and Post-nuptial agreements (after marriage) referred to together as “Nuptial Agreements” are not strictly legally binding on the courts, they have ruled that in certain circumstances, such agreements will have real weight in deciding the financial terms of any divorce settlement. It is clear is that having an effective and well drafted Nuptial agreement will greatly assist with planning and setting out your finances and giving you peace of mind either before or after you get married to protect their assets in the event of relationship breakdown.
In the case of a pre-nuptial agreement, we would advise you to sign it well in advance of your wedding (ideally, at least 28 days) and for both you and your partner to independently take legal advice on the proposed contents.
WHAT IS A NUPTIAL AGREEMENT?
A Nuptial agreement provides a clearly set out agreement about how different assets should be treated and what each of you would like to happen to your assets in the event of the breakdown of your marriage. It may be that one of you has more assets that the other – perhaps you have inherited family assets. Couples who are getting married do not consider writing detailed statements about their finances and how they are to be divided and a Nuptial Agreement does that, avoiding the need for future disputes. You both know exactly where you stand and have peace of mind.
WHAT THE COURTS SAY ABOUT NUPTIAL AGREEMENTS
Since the case of Radmacher v Garantino upheld the terms of an agreement the courts have had to consider any Nuptial agreements as a preliminary issue before going on to decide whether or not they decide if they are fair or not.
