Getting a Divorce in England and Wales
A couple can get a divorce in England and Wales if:
1. They have been married for at least 12 months and;
2. There has been an irretrievable breakdown of the marriage.
To prove the marriage has broken down irretrievably, it must be shown that there has been one of the following five elements:
- Adultery
- Unreasonable behaviour
- Two years' separation with consent
- Five years' separation (without consent )
- Desertion (for a period of at least two years)
Once the court is satisfied that the grounds for divorce have been met, they will pronounce Decree Nisi (a conditional order). This is later followed by the Decree Absolute, which is the final order that formally ends the marriage.
