  • opposed an application for dispensation of statutory consultation obligations pursuant to S20 Landlord and Tenant Act 1985, originated by the freeholder of a large residential development located in a major U.K.city.
  • The Freeholders application was based upon the urgency of a large number of major works and fire safety.
  • Sherry (a very experienced Higher Rights Advocate) conducted her clients defence to the proceedings, argued that the application should be dismissed upon the basis of a number of irregularities in the application itself, the locus standi of the party bringing the application, and the freeholders continuous failure to comply with court orders.
  • The Tribunal held, dismissing the application ,that the leaseholders cannot be charged more than £250.00 per leasehold property, despite the freeholder incurring costs of the works.
  • The Tribunal also granted the leaseholders permission to seek costs, on the basis of the unreasonable behaviour.
  • Sherry is an extremely experienced and successful property litigator, who acts for both freeholders and leaseholders in property litigation cases.
