Another successful Firearms appeal for Lewis Nedas Law

firearm certificateOur in-house Firearms Law specialist Laura Saunsbury recently acted for the brother of a Member of Parliament in his appeal against the revocation of his shotgun certificate. The Metropolitan Police’s decision to revoke our client’s certificate was based on a number of false complaints to the police by his ex-girlfriend. Laura prepared a comprehensive bundle of evidence for our client rebutting these allegations. Having considered the evidence and Laura’s written representations on behalf of our client, the police were persuaded to reinstate his shotgun certificate without the need or expense of a contested hearing. On receiving the good news our client’s reaction was as follows; 

“Absolutely fantastic news, and congratulations on achieving this for me. I am so delighted, thank you very much for all you’ve done. I won’t hesitate to recommend you to anyone with similar problems”.

Another firearms licensing appeal successfully settled by Laura Saunsbury

firearmsOur firm's firearms law specialist Laura Saunsbury has been enjoying a run of successes in settling firearms licensing appeals for her clients, without needing to take the case to a full hearing in the Crown Court. Throughout 2017 Laura has dealt with a series of appeals against various police forces in England and Wales where she has presented such a strong case on paper for her client that the police have been persuaded to reconsider their decision and have voluntarily reinstated her client's firearm and/or shotgun certificate. In one such case which she successfully resolved last month, Laura's grateful client had this to say about her work:

"Laura Saunsbury at Lewis Nedas previously helped me enormously when I was wrongly accused of a criminal offence.  After being acquitted so completely by the jury in crown court, and my accuser found to be lying by the judge himself, you can imagine my dismay to then have my firearms certificate revoked by the police. Another firearms appeal successfully resolved for Lewis Nedas client and Laura Saunsbury

firearmsOur in house expert in firearms licensing appeals, Laura Saunsbury, successfully negotiated a settlement of yet another appeal last month. Our client, an experienced shooter who had held his firearm and shotgun certificates for many years, sought Laura's help when his certificates were revoked in October 2015 following his arrest over a parking dispute.

In spite of our client being cleared of any wrongdoing in this and a number of other alleged incidents in the past, for a long time the Police continued to contest our client's appeal. The case had been scheduled for a 3 day hearing at Lewes Crown Court in mid October 2016. However, after two preliminary hearings and persistent pressure from Laura on the police to reveal further information about the background to the various allegations and the character of the complainants, the police eventually reconsidered their objections and agreed nearly a year later in September 2016 to reinstate both of our client's certificates. 

Our client was a member of two national shooting organisations, the CPSA (Clay Pigeon Shooting Association) and the NRA (National Rifle Association), and was fortunate to have legal expenses insurance through both organisations which between them funded his legal costs. In writing to both organisations to express his appreciation our client made the following comments;

Militaria collector spared jail in another success for Lewis Nedas client and firearms law specialist Laura Saunsbury

ammunition 1In another success for firearms law specialist Laura Saunsbury and LNL, one of the country's most well known militaria collectors was spared from a jail sentence after pleading guilty to possession of a small quantity of live ammunition.

A two year ordeal which began in September 2014 finally came to an end in late September 2016 when Judge Carroll in sentencing our client at St Albans Crown Court stated "there is nothing wrong with your hobby... I accept you had no criminal intent". The case attracted considerable media attention, particularly at the time of our client's arrest and was later profiled on an episode of the BBC Countryfile programme.

A fireman with a keen interest in military history, our client admitted possession of a small quantity of live ammunition but was cleared of the majority of the charges.

Laura's careful preparation of the case, which included working closely with the leading independent expert witnesses on firearms and explosives, David Dyson and Stephen Aldred, was key to the successful outcome. In court our client was most ably represented by the specialist firearms barrister Nick Doherty who persuaded Judge Caroll that even a suspended prison sentence was not necessary and to limit our client's punishment to unpaid community work.

Another success for Lewis Nedas law and Laura Saunsbury in Firearms Certificate Revocation case

firearm certificateA retired deputy head teacher in Southern England who had held his firearm and shotgun certificates for more than 50 years, sought the help of our firearms law specialist Laura Saunsbury after the Police revoked his certificates following an unfortunate road accident. With Laura’s help an appeal was lodged and detailed representations were made to the Chief Constable to carefully review the revocation decision. Very soon afterwards our client’s certificates were reinstated by the Police without the appeal ever having to go into court. In writing to express his appreciation he said the following; 

There is no doubt in my mind, Laura, that your name and expert input were instrumental in achieving the reversal of my firearms licence revocation. I am absolutely delighted and thank you once again for your invaluable help and support in this matter.”
