Another Rape Defence Success for Lewis Nedas & Co

January 11, 2010

Leila Abdul-Rasool represented a client on 10 December 2009 at Inner London Crown Court who was acquitted by unanimous verdict of attempted rape and indecent assault after a fully contested trial. At the time of the incident the client was 19 and the victim 14 years. Old law applied to the case as it pre-dated 2003 Act.
It was a historical allegation — the client came to be arrested five years after incident. He had a minor altercation with his wife that was not proceeded with, but he was discovered wanted by a DNA match. He spent three months in prison before being bailed. Due to the nature of the offence, Social Services became involved with his family and he was not allowed unsupervised contact with his children.
The complainant gave a number of different accounts. A basis of plea that they had had sexual contact (kissing and hugging) which was consensual was put forward, on which the Prosecutor sought the views of the victim. She said that she did not agree, but would accept the basis. This was relayed to the judge who then threatened to have the victim arrested for perverting the course of justice. The following day the Crown said that they would be proceeding to trial on both counts, after which the client was unanimously found not guilty.
Counsel was John Femi-Ola of 3 Temple Gardens.

Snaresbrook Crown Court Rape Acquittal

October 13, 2009

Unan Choudhury robustly defended a man charged with the offence of marital rape. Unan is a fluent Bengali speaker, as is the defendant and the vast majority of prosecution and defence witnesses. At one stage much concern was raised about the quality of the court interpreter's performance so Unan was asked by the trial Judge to step in. He was praised by trial counsel for his commitment and dedication to the case.
The defendant was brilliantly represented by Dee Connolly of counsel (3 Temple Gardens) who secured an acquittal from the jury after less than an hour's deliberation.

Another Court of Appeal Success for Lewis Nedas & Co

July 23, 2009

Tony Meisels has successfully appealed to the Court of Appeal focusing upon a condition of a Sexual Offence Prevention Order (50 P0) which prohibited the appellant from using any internet enabled device except for the purpose of his employment.

The Court of Appeal allowed the appeal which in part was lodged due to the appellant's heavy reliance on the internet for social and domestic purposes. The Court also recognized the appellant's efforts towards rehabilitation as since the time of his arrest. The newly worded Sexual Offences Prevention Order now merely prohibits the appellant from using the internet to access child pornography and this will now become a leading case when the courts determine the wording of Sexual Offences Prevention Orders as they relate to access to the Internet".

Jeremy Lynn of Farringdon Chambers ably represented the appellant.

Conviction Overturned at the Court of Appeal

July 20, 2009

The Court of Appeal has overturned the convictions of indecent assault for one of this firm's clients.
Siobhain Egan has represented an individual whose convictions of indecent assault were decreed to be unsafe by the Court of Appeal. Information uncovered by enquiry agent Stephen Cooper (www.falselyaccused.co.uk) indicated that the complainant had lied about the allegations. It was also discovered that the CPS had failed to disclose, both to their own counsel and the defence, important contradictory information supplied by the complainant about the allegations which she had made.
The client was ably represented by Nadine Radford QC.

CPS Drop Charges in Rape Case

Siobhain Egan was recently instructed to represent a defendant facing an allegation of rape which involved a very well known television personality. However, due to Siobhain's continued efforts and representations made on behalf of the client, the Crown Prosecution Service withdrew their allegations.
