• A professionally drafted, valid will;
• A Lasting Power of Attorney to deal with your financial and property affairs in the event you lose capacity;
• Safe storage of original documents.
Appointment
A face to face meeting with a qualified solicitor when you can tell us about you, your current personal circumstances, financial situation and future plans so we can help you to plan for that future.
We will take details of your finances; your savings and investment; your life insurance and pension arrangements; any property that you own (and how you own it) and any debts that you have.
We will look at the issue of inheritance tax, how much it is likely to be, how the money will be raised to pay the tax. Getting a complete picture of your financial situation will help us to advise you on any possible ways to minimise the liability to inheritance tax.
Your Will
Many people just assume that their assets will go to their spouse and that they do not need to make a will. They do not realise that this is not necessarily the case. A properly drafted will can help to ensure that your assets end up with the people you intend.
If you have young children you need to consider who you would like to look after them; where you would like them to live and how best to provide for them.
You may own assets abroad. Some countries will not accept English wills. We can advise you on whether you need to make a foreign will.
You can include your funeral wishes so that your executors can be sure that you are getting the ending you wanted.
Lasting Power of Attorney
With an increasingly aging population, the risk of losing the ability to manage your own affairs because of incapacity is sadly a scenario we now have to consider and plan for.
A financial lasting power of attorney allows you to chose the person (or persons) you trust most to look after your money and property should you ever become incapable of doing so yourself.
Before the Lasting Power of Attorney (LPA) can be used, it has to be registered with the Office of the Public Guardian. There is a registration fee of £130 (which we have to pass on to you). Although the LPA does not have to be registered until it is needed, we believe it is better to register it sooner rather than later and so we include the registration process as part of our standard fee if it is done at the same time.
You may also wish to consider Welfare LPA’s and ‘Living Wills’ and we can advise you on these during our appointment and provide them for you, if appropriate, for an additional fee.
Storage
These documents are important and need to be kept somewhere safe. We can store them for you, free of charge.
