			<content:encoded><![CDATA[<p>In a blaze of recent publicity Richard Alderman has mooted the idea that the US style Deferred prosecution arrangements would be beneficial to the SFO, especially when dealing with Bribery investigations.</p>
<p>This will undoubtedly be a controversial move and is unlikely to find favour with the UK Judiciary and public alike. It will suggested that these large, often multi -national, companies can simply buy their way out of a prosecution.</p>
<p>The advantages to the SFO are obvious &#8211; it will save them hugh expensive investigations and POSSIBLY allow them to affect the bribery culture of a company through monitoring company systems and processes. It would also decrease the number of high profile prosecutions which have collapsed in the past.</p>
<p>However these DPAs are not without their difficulties &#8211; it pre-supposes a highly discretionary and subjective process of selecting those companies that will be eligible for DPAs&#8230;why some companies and not others?</p>
<p>Will there be any judicial intervention at all?</p>
<p>Who is going to determine the penalties the company should face?</p>
<p>Will the companies be expected to enter the DPA before charges are laid and admit liability then (this would save the SFO large amounts of money)</p>
<p>Will there be any immunity for whistle blowing participants?</p>
<p>This is a very interesting development, especially as it is believed that the SFO have 17 current Bribery investigations.</p>
