Court of Appeal Success for Sam Corcoran
April 3, 2012 by Lewis Nedas
Sam Corcoran represented an elderly woman prosecuted by SOCA and the CPS, who was initially convicted of allowing her home to be used to supply class A drugs, which she denied.
Sam ensured that her appeal was expedited and heard within two months by the Court of Appeal, who promptly quashed the conviction upon the basis that the charge was not made out. A fundamental element of the charge had not been proved by the Crown.
Jeremy Ornstin and Grant Vanston (187 Fleet Street Chambers) were the advocates in this appeal.
FSA Changing Their Approach?
April 3, 2012 by Lewis Nedas
Fresh reports suggest that the FSA are taking a more aggressive approach to wrongdoing in the City.
Despite the fact that the number of dawn raids against companies was down last year to twenty-one (there were twenty-six such raids in 2007), the FSA are now suggesting proposals for strict liability offences against directors/managers in the event of bank failures. Next month they bring a prosecution against a healthcare company for allegedly producing false and misleading statements to the market.
In the event that you are the subject of a FSA dawn raid or investigation contact enquiries or Jeffrey Lewis, Siobhain Egan, Miles Herman, Keith Wood.
USA to Review 2003 Anglo–American Extradition Treaty?
April 3, 2012 by Lewis Nedas
It seems that after PM Cameron’s recent visit to the US, America has agreed to review the controversial treaty. This follows an earlier promise by Teresa May in November 2011 after the very thorough Baker Review.
A number of recent successful deportations to the US have caused deep anger, primarily because the 2003 treaty was aimed at alleged terrorism.
We have an excellent extradition team, Leila Abdul-Rasool and Nick Wragg, who in turn work with leading extradition counsel.
Vast Increase in Land Banking Fraud Investigations
April 3, 2012 by Lewis Nedas
City of London Fraud Police are currently involved in a large number of ‘land banking fraud’ investigations across the country. These frauds are very similar to the ‘boiler room share frauds’ but focus instead upon allegedly falsely representing that land is suitable for future development and which are, according to Police, simply bogus developments.
We have considerable, successful experience of defending both these and ‘boiler room’ frauds. Contact enquiries or Jeffrey Lewis, Siobhain Egan, Miles Herman, Keith Wood.
High Court Extradition Success for Nicholas Wragg and Counsel James Stansfeld
March 23, 2012 by Lewis Nedas
Mr V’s extradition was sought pursuant to five European Arrest Warrants issued by Hungary to prosecute him for thirteen offences of fraud. Whilst not all offences could be challenged there was, in addition to a successful challenge to the first warrant that Mr V cannot be extradited for that offence, a new argument was raised because three of the warrants sought extradition for the same offences. In agreeing with James Stansfeld’s arguments, Mr Justice Keith held that Mr V could not be extradited for any of those offences unless Hungary decides to only prosecute Mr V for two out of the four offences. We are awaiting Hungary’s decision. It should be noted that whilst Mr V will invariably be extradited Hungary will be prevented from trying him for offences that he was not permitted to be extradited for. This may have a significant impact on the length of sentence he would face if convicted.
