Fantastic Result in Revenue Investigation

Siobhain Egan has been instructed to represent an individual who, along with 24 others, faces trial in Liverpool Crown Court concerning allegations focusing upon importations of large seizures of class A drugs (500kgs of cocaine/heroin) and money laundering.

Was This Really In The Interests Of The Child?

Nick Wragg recently represented a mother whose child, with psychological problems, refused to attend school.

Westminster Council insisted upon prosecuting our client; she was refused legal aid for us to represent her as it was decided that the Court Clerk could assist her! This, despite the fact that this is a strict liability offence with serious consequences for her should she be convicted! Eventually, after many appeals, legal aid was granted but funding to instruct an expert paediatric psychiatrist to assess the child was refused. After another appeal that funding was eventually granted.

This eventually resulted in the case against our client being dropped on the first day of trial. The Court held that her prosecution was unreasonable and a full costs order was made in our client’s favour and against Westminster Council.

Congratulations to Nick Wragg whose sheer determination, tenacity and advocacy won the day.

The overwhelming principle in any case concerning children is what is in the best interests of the child – something which obviously both Westminster Council and the Legal Services Commission overlooked, ignored, or simply refused to consider in this case.

Another Stunning Success for Lewis Nedas and Great James Street Chambers

Nicholas Wragg, working with Gerry Mohabir (leading counsel) and Abigail Bache of Great James Street Chambers, secured a stunning success in the Court of Appeal on 1 November 2010, resulting in the overturning of our client’s conviction and nine year sentence of imprisonment.

Our client was charged following a complicated surveillance and RIPA operation concerning the alleged supply of firearms in London. He had always strenuously denied any involvement.

Following detailed and complicated submissions concerning the law of criminal conspiracy, which were brilliantly argued by Gerry Mohabir, the Court of Appeal agreed that his conviction was unsafe and he was released immediately.
