Exceptional Hardship Success in Appeal against Driving Disqualification

Jeffrey Lewis acted for an individual who was disqualified from driving after have amassed twelve points on his/her licence. The exceptional hardship argument was rejected by the Magistrates’ Court who imposed a six month ban. He appealed his client’s case and after careful argument, which was supported by a mass of relevant documentation, the appeal was allowed in the Crown Court. Siobhain Egan represented the appellant in the Crown Court.

The courts across the country are taking a much tougher attitude to these disqualifications and ‘exceptional hardship arguments’, and even if it means that an individual may loose his/her job/home lengthy disqualification periods are put in place.
