Jeffrey Lewis and Keith Wood are acting for an individual who is the subject of an extradition request made by the Government of the United States in connection with allegations concerning a Ponzi fraud to the value of $5million. The client was granted bail, despite rigorous objection by the American government, after our bail application was superbly argued by Rebecca Hill of counsel (Great James Street Chambers).

Exceptional Hardship Success in Appeal against Driving Disqualification

Jeffrey Lewis acted for an individual who was disqualified from driving after have amassed twelve points on his/her licence. The exceptional hardship argument was rejected by the Magistrates’ Court who imposed a six month ban. He appealed his client’s case and after careful argument, which was supported by a mass of relevant documentation, the appeal was allowed in the Crown Court. Siobhain Egan represented the appellant in the Crown Court.
The courts across the country are taking a much tougher attitude to these disqualifications and ‘exceptional hardship arguments’, and even if it means that an individual may loose his/her job/home lengthy disqualification periods are put in place. New Extension of Powers under Civil Recovery Orders

Nick Brett represented a client facing a claim for civil recovery in connection of allegations of drug trafficking and money laundering which were dismissed by the Court, but it was held that a Civil Recovery Order was valid where allegations of false and misleading statement on a mortgage application form had been proved against the client. Case reported at SOCA v Pelekanos EWHC 2307.

Another great success for Nick Wragg and James Stansfeld of counsel (Great James Street Chambers): they recently defended a woman of impeccable character who was employed as a carer; allegations of theft were made against her which she vehemently denied. The CPS failed to adduce proper work sheets and rotas and chose to rely instead upon third party hearsay evidence which we successfully argued was inadmissible. Our client was acquitted.
Acquittal on Firearms Case for Lewis Nedas

Chantelle Peters-Augustine acted for a defendant charged with possession of a prohibited weapon (firearm). The client was brilliantly represented by Nick Doherty of counsel (10 King’s Bench Walk) who specialises in defending firearms prosecution and who instructed David Dyers, a leading firearms expert. The Crown’s case was based on circumstantial evidence and was rejected by the jury.
The Camera Never Lies

Nick Wragg recently defended a client at trial facing allegations relating to public order and assaulting a police officer.
The entire incident had been recorded by an independent film maker. We asked for a copy of the film from the CPS and found contrary to the signed statements by police officers, our client was not given an appropriate warning and the officer had in any case acted outside the execution of her duty by grabbing the client. Further, the client was then thrown to the ground by the officer whose dog then bit the client’s thigh.
Nick wrote to the CPS asking them to review the film and reconsider their position. The CPS decided to proceed and the trial went ahead. It was stopped by the court shortly after the film had been shown and proceedings against our client were stayed.
A complaint about the police behaviour and the lack of veracity within their statements is likely to be made to the IPCC.

Siobhain Egan acted for the wife of an internationally renowned singer / musician / producer who was accused of assault. We managed to find an independent witness and a great deal of background information about the complainant which enabled us to proffer detailed representations to the police and persuaded them to drop the proceedings.
