Another Stunning Fraud Acquittal for Lewis Nedas

October 15, 2009 by Lewis Nedas

Miles Herman successfully represented the only defendant of five to be acquitted following trial at Southwark Crown Court. The defendant, an Uzbek national, was accused of being involved in a complex computer fraud using trojan viruses. Much of the documentation had to be carefully translated in Russian and vice versa, and required detailed, painstaking analysis.

The client was brilliantly represented by counsel David Burgess of 9 Bedford Row.

For more information on the case, please see the following articles in The Independent: http://www.independent.co.uk/news/uk/crime/pound600000-internet-fraud-gang-faces-jail-1802536.html, and the BBC: http://news.bbc.co.uk/1/hi/england/london/8307346.stm.

The Importance of Instructing a Good Solicitor

October 13, 2009 by Lewis Nedas

Nick Wragg recently represented a woman facing a series of grave allegations of benefit fraud involving large sums. Her initial charges would have meant that she was likely to face seven years imprisonment upon conviction. Using a mixture of dogged perserverance and Welsh charm, Nick managed to persuade the prosecution to accept guilty pleas to much lesser offences. After offering detailed, substantial and weighty mitigation upon the client’s behalf, she was eventually ordered to pay a fine of £600.00. Our client was delighted.

Snaresbrook Crown Court Rape Acquittal

October 13, 2009 by Lewis Nedas

Unan Choudhury robustly defended a man charged with the offence of marital rape. Unan is a fluent Bengali speaker, as is the defendant and the vast majority of prosecution and defence witnesses. At one stage much concern was raised about the quality of the court interpreter’s performance so Unan was asked by the trial Judge to step in. He was praised by trial counsel for his committment and dedication to the case.

The defendant was brilliantly represented by Dee Connolly of counsel (3 Temple Gardens) who secured an acquittal from the jury after less than an hour’s deliberation.

Concerns About Prosecution Bonuses

October 5, 2009 by Lewis Nedas

An article in The Times (05/10/09) highlights long held views by defence lawyers that confiscation targets set by the Home Office (ASSET RECOVERY INCENTIVISATION SCHEME) and bonuses paid to staff in prosecuting/investigative agencies have resulted in miscarriages of justice. Particular focus centres on those convicted of  revenue/VAT offences and those convicted of tobacco smuggling. It seems that over 4,000 files are currently being reviewed by RCPO – it is believed that confisaction procedings have been brought unlawfully against each of these individuals.

It is vital that if you are facing a tax/VAT/criminal investigation/proceedings you MUST ensure that you have instructed lawyers who are experienced in this field.
